Export Policy

Export policy and export restrictions

Parts of our business are subject to U.S. export controls administered by the U.S. Department of State's Directorate of Defense Trade Controls, the U.S. Department of Commerce's Bureau of Industry and Security and the U.S. Department of the Treasury's Office of Foreign Assets Control. Please read the information below about the export rules that may apply to your order.

Selling, transferring, transporting or shipping outside the United States any product whose export is prohibited or restricted, without the export license, documentation or authorization U.S. law requires, is strictly prohibited and may lead to civil penalties or be a federal crime. Apogee Inc, which operates 2AForce ("Apogee"), will not take part in any transaction that requires an illegal export and will not help, directly or indirectly, with the illegal export or re-export of any product. An accurate Automated Export System (AES) filing is required for every export, whether or not a license is needed.

If you intend to ship or use a product outside the United States, tell us so in your order. Depending on the order value, the products, the end user, the country of final destination and the end use, Apogee may need to apply for an export license from the relevant U.S. government agency. Products that may require an export license include, among others:

  • Generation 2, 3 and 4 night vision equipment and accessories
  • Thermal imaging equipment and heat seekers
  • Optical sighting equipment and tactical lights (handheld and weapon-mounted), with their accessories and mounting hardware
  • Tactical gear and weapon accessories
  • Knives
  • Military apparel, including body armor, helmets, helmet accessories and shields
  • Some laboratory and electronic equipment
  • Respiratory protection equipment

For shipments to APO/FPO/DPO addresses, see our Shipping Policy.

International Traffic in Arms Regulations (ITAR)

Some products on this website are subject to the ITAR and may not be exported without authorization or a license from the U.S. Department of State's Directorate of Defense Trade Controls. By placing an order for an ITAR-controlled product, you confirm that:

  1. the purchase does not require Apogee to export the product, unless Apogee knows about the export and has obtained the required U.S. Government authorization;
  2. you do not intend to export the product after you receive it without the required U.S. Government export authorization;
  3. you do not intend to export, transfer, sell or provide the product to any foreign person, in the United States or abroad, including foreign embassies in the United States, without the required U.S. Government export authorization;
  4. you understand that under ITAR § 120.16 a foreign person is any natural person who is not a lawful permanent resident under 8 U.S.C. § 1101(a)(20) or a protected individual under 8 U.S.C. § 1324b(a)(3), and can also be a foreign corporation, business association, trust, society or other entity or group not incorporated or organized to do business in the United States, an international organization, a foreign government, or any agency or subdivision of a foreign government (for example a diplomatic mission); and
  5. you are a U.S. Person as defined in ITAR § 120.15: a lawful permanent resident under 8 U.S.C. § 1101(a)(20), a protected individual under 8 U.S.C. § 1324b(a)(3), an entity incorporated to do business in the United States, or a U.S. federal, state or local government entity.

Export Administration Regulations (EAR)

Some products on this website are subject to the EAR, and their export may be restricted by the U.S. Department of Commerce's Bureau of Industry and Security. By placing an order for such a product, you confirm that (1) the purchase does not require Apogee to export the product, unless Apogee knows about the export and has obtained the required U.S. Government authorization, and (2) you do not intend to export the product after you receive it without the required U.S. Government export authorization.

Important export restrictions

Exporting some of the products we sell is strictly prohibited without a valid export license from the U.S. Department of State under the ITAR (22 C.F.R. 120–130) or from the U.S. Department of Commerce under the EAR (15 C.F.R. 730–774).

U.S. law prohibits selling, transferring or exporting products to certain restricted parties, destinations and embargoed countries listed by the U.S. Departments of State, Commerce and the Treasury. You are responsible for knowing these lists, which are published on the government websites below. By placing any order, you confirm that you will not take part in any unauthorized export of products bought from 2AForce to restricted parties or destinations, and that you will comply with all applicable laws, regulations and administrative policies.
